Company seeks writ to make BofA pay for court judgment over woman's debt

A Houston company claims money it is owed by a Houston woman is being held by Bank of America.

Old West Capital Co. filed a writ of garnishment after judgment Sept. 13 in Jefferson County District Court against Bank of America Corp. and Rhonda P. Graham. 

The complaint states that Jefferson County 58th District Court Judge Bob Wortham ordered Graham to pay Old West Capital $6,393.05, plus post-judgment interest at 18 percent per annum and costs. The judgment was rendered on March 9, 2005, according to the complaint.

Now, Old West is seeking the money from Bank of America, saying it holds Graham’s money, which could be used to pay toward her debt.

In addition to the writ of garnishment, Old West seeks a judgment, plus interest, costs, post-judgment interest and other relief the court deems just.

Aubyn K. Shettle Jr. and Alisa S. Richman of Dallas will be representing it.

Judge Milton Shuffield, 136th District Court, has been assigned to the case.
