McKinney man sues Colorado company for obtaining copy of his credit report

SHERMAN - A McKinney resident has filed a lawsuit against a Colorado company claiming that it violated federal law by obtaining a copy of his consumer credit report without a purpose.

Jerry McCall filed suit against Cach LLC on Sept. 16 in the Eastern District of Texas, Sherman Division.

The defendant is accused of violations of the Fair Consumer Reporting Act for obtaining copies of McCall’s consumer report with no permissible purpose. McCall states that at no time did he give consent for the defendant to acquire his consumer report from any consumer reporting agency.

The plaintiff is seeking an award of statutory damages of $1,000, punitive damages, attorney’s fees and court costs.

McCall is acting as his own attorney. A jury trial is requested.

U.S. District Judge Richard A. Schell is assigned to the case.
