Debt collection agency sued after claiming to be legal department

SHERMAN - A Collin County woman has filed a lawsuit against a debt collection agency claiming the debt collector violated federal and Texas law by identifying itself as a caller from the legal department.

Mary Lombardo filed suit against Credit Solutions Corp. on Sept. 27 in the Eastern District of Texas, Sherman Division. 

According to the lawsuit, Lombardo had an account that went into default and was placed into collections. She disputes the account and has requested that the defendant cease all further communication on the account.

The defendant is accused of leaving several messages for Lombardo where it identified itself as a caller from the “legal department.”

The defendant’s actions alleged violated the Fair Debt Collection Practices Act and the Texas Finance Code and invasion of privacy.

The plaintiff is seeking an award of actual and statutory damages, attorney’s fees and court costs.

Lombardo is represented by Jeff Wood of The Wood Firm in Rockwall.

A jury trial is requested.
