TYLER - A restaurant worker has filed a lawsuit against a Palestine restaurant claiming he was not paid minimum wages or overtime wages.
Bobby Gibson filed suit against Bib Beijing Inc. and Ming Zhao Zhu on Oct. 2 in Eastern District of Texas, Tyler Division.
Gibson was employed as a dishwasher at the Bib Beijing restaurant located in Palestine, Texas. He states he was an hourly-paid employee who routinely worked 80-85 hours a week at a rate that was well below minimum wage.
The defendants are accused of violating the Fair Labor Standards Act by failing to compensate Gibson minimum wages and for not paying overtime wages.
The plaintiff is seeking an award of damages, liquidated damages, court costs, attorney’s fees and interest.
