SHERMAN - A Paris, Texas, man has filed a lawsuit against a debt collection agency for making numerous telephone calls in which a debt collector threatened to contact his family and threatened to file a lawsuit.
Mark V. Hankins filed suit against Spears, Dewitt & Hall on Sept. 30 in the Eastern District of Texas, Sherman Division.
The defendants allegedly attempted to collect a consumer debt from Hankins regarding an IBC Bank account. Hankins states that a representative contacted him, asked for account information of his family and friends, and threatened to sue him.
The defendant is accused of making numerous telephone calls to Hankins in an effort to “intimidate, annoy, harass, upset, and coerce payment.”
The defendant is accused of violating the Fair Debt Collection Practices Act and the Texas Fair Debt Collection Practices Act, which prohibit debt collectors from engaging in abusive, deceptive and unfair practices.
The plaintiff is seeking an award of actual damages, statutory damages, attorney’s fees and court costs.
Hankins is represented by Amy L. Bennecoff of Kimmel & Silverman PC in Ambler, Penn. A jury trial is requested.
U.S. District Judge Ron Clark is assigned to the case.
