Office manager sues Lindale business for unlawful retaliation

MARSHALL - An office manager has filed a lawsuit against a Lindale business claiming she was fired less than 24 hours after complaining about her manager’s racist and sexist remarks.

Kathy J. Hays filed suit against Lindale Healthcare, doing business as Colonial Nursing and Rehabilitation Center, on Oct. 2 in the Eastern District of Texas, Marshall Division.

Hays was hired by Lindale Healthcare in May 2013 as a Business Office Manager. She claims that during her weeks of employment her supervisor made numerous racist and sexist remarks. She claims she complained to Lindale Healthcare on July 25 and was fired the next day, according to the suit.

The defendant is accused of unlawful retaliation for discriminating or retaliating against Hays because she opposed an unlawful employment practice.

The plaintiff is seeking an award of damages for back pay, front pay, loss of employment benefits, mental anguish, inconvenience, punitive damages, attorney’s fees, court costs and interest.

Hays is represented by Gregory S. Porter of Porter Law Firm P.C. in Tyler. A jury trial is requested.

U.S. District Judge Rodney Gilstrap is assigned to the case.
