Property owner sues insurance company for compensation from hurricane damage

A Beaumont property owner is suing its insurance company after the company failed to compensate for property damage caused by Hurricane Ike.

Greentree Village Investments Ltd. filed a lawsuit Sept. 26 against Texas Windstorm Insurance Association in the District Court of Jefferson County, citing breach of contract, breach of fiduciary duty and violations of the Texas Insurance Code.

According to the filing, Greentree Village Investments owns property on Dowlen Road in Beaumont, which was damaged by Hurricane Ike on Sept. 18, 2008. The property was insured through the defendant at the time of the incident. The plaintiff alleges that a timely claim was made following the incident, but the defendant has failed to compensate the plaintiff for property damage.

Greentree Village Investments is seeking to recover actual damages, additional damages and court costs. They are being represented in the case by Beaumont attorney Jason M. Byrd of the Byrd Law Firm.
