GALVESTON - A business sued over the alleged theft and destruction of trailers denies any wrongdoing.
As previously reported, Daryl Marsh brought a lawsuit against James Bradley Wright and Kodiak Resources Inc. last month in response to the dispute over said trailers.
Marsh claims the trailers belonged to him and Wright stole them, adding the latter took them to Kodiak Resources Inc.’s facilities for recycling, adding the company took possession of them without his consent and “destroyed them in the recycling process.”
The company, doing business as Kodiak Metals Recycling Inc., reportedly refused to return the trailers after the plaintiff asked for them.
“Wright and Kodiak wrongfully exercised dominion and control over the two trailers,” the original petition says.
In an original answer filed Oct. 7, Kodiak insists the trailers were purchased, not stolen.
"The incidents and damages in question were proximately caused by the actions of third parties who were not subject to control by this defendant and for whose acts and omissions this defendant is not legally responsible," the three-page document says.
