Wreck ejects Houston man from motorcycle, according to court documents

Todd jeffrey

GALVESTON - Houston resident Charles Bolton claims he was involved in a two-vehicle accident in Galveston almost two years ago while riding his motorcycle.

A lawsuit filed Oct. 18 in Galveston County District Court attributes the wreck in question on Nov. 4, 2011, to Katy resident Laverne Tallman.

Prior to the accident, Bolton was traveling westbound in the right lane in the 11150 block of FM 3005 as was Tallman.

The plaintiff then slowed down to make a right hand turn into a public business, prompting the vehicle behind him to slow for traffic.

According to the suit, Tallman struck the vehicle tailing Bolton and "caused that vehicle to violently strike" Bolton's bike.

Bolton and his passenger were subsequently ejected, the original petition says.

Said passenger is not a party in the litigation.

Tallman is blamed for:

  • Failing to keep a lookout;

  • Failing to control his speed;

  • Failing to timely and properly apply the brakes; and

  • Failing to make movements that would have averted the subject collision.

Consequently, Bolton seeks unspecified monetary damages.

He is represented by attorney Jeffrey N. Todd of The Law Firm of Alton C. Todd in Friendswood.

The case has been assigned to Galveston County 10th District Court Judge Kerry L. Neves.
