GALVESTON - Pearland residents John and Kathy Cisneros pursued legal action in response to a two-vehicle accident in League City which occurred two years ago, recent court papers say.
A lawsuit filed Oct. 28 in Galveston County District Court claims a vehicle owned and operated by Alvin resident Tony Courtney struck that occupied by the plaintiffs on Oct. 28, 2011.
The claimants were stopped at a traffic light on an unidentified street at the time of the event in question.
According to the original petition, Courtney "violently" collided into the rear-end of the Cisneroses' vehicle and inflicted injuries to the complainants' necks, backs and general bodies.
He is faulted for:
- Failing to keep a proper lookout;
- Failing to turn his vehicle in an effort to avoid the collision;
- Failing to maintain a clear and reasonable distance between himself and the plaintiffs; and
- Failing to apply his brakes.
Consequently, the Cisneroses sue for physical pain and suffering, impairment, disfigurement, mental anguish, lost wages and medical expenses.
A jury trial is requested.
