A local attorney is being sued after allegedly committing professional malpractice.
Slena Graves and Larry Graves filed a lawsuit in Jefferson County District Court in October against attorney Scott Pawgan and his Huntsville firm Habern O'Neal & Pawgan LLP, citing negligence, breach of contract, joint and several liability, fraud and fraudulent inducement.
The plaintiffs state they retained the defendant for $30,000 to file a Habeas Corpus petition. According to the lawsuit, instead of filing the petition, the defendant filled out a form found online with a few sentences added but no substantive legal argument.
The plaintiffs contend the fee was unreasonable.
The plaintiffs are seeking an undisclosed amount in damages.
They are represented in the case by John S. Morgan of Morgan Law Firm.
The case has been assigned to Judge Bob Wortham, 58th District Court.
