GALVESTON - An alleged two-vehicle accident in a League City parking lot last year has yielded a lawsuit, recent court papers say.
Misty Smith Ward, Laura Ward, Kenneth Ward and Eddie Ward initiated legal action against Dickinson local Starla Lynn Moinat over the April 12, 2012, incident in Galveston County Court at Law No. 3 on Nov. 14.
The plaintiffs explain that they were driving through said parking lot in the 100 block of FM 646 just as the subject wreck occurred.
According to the suit, the defendant "unsafely" backed her car into that carrying the complainants.
It additionally asserts that she "had been consuming alcohol."
The respondent is blamed for:
- Failing to keep a proper lookout;
- Failing to timely apply the brakes;
- Failing to take evasive action; and
- Failing to control speed.
A relative of the motorist, Stacy Diane Moinat, is a co-defendant in the case though her supposed role in the event is not mentioned.
The original petition further shows the plaintiffs "have spent much time and money undergoing medical treatment for the injuries they suffered in the crash."
Consequently, they seek unspecified monetary damages.
Attorney Robert D. Clements Jr. of the Law Office of Robert D. Clements Jr. & Assoc. in Alvin is representing the claimants, and Galveston County Court-at-Law No. 3 Judge Kerri M. Foley is presiding over the case.
