A lawsuit claiming a driver made an unsafe lane change and caused a collision has been settled a few days before the case was slated to go to trial.
According to the original complaint filed Oct. 1, 2012, in Jefferson County District Court, Gertrude McBride claims she and minor Cecil McBride III were traveling west in the 3200 block of E. Lucas in Beaumont on June 28, 2012, when defendant Odell Mack Sr. allegedly made an unsafe lane change and struck their vehicle.
The case was slated to go to trial Monday, Nov. 18, but settled Friday, Nov. 15, according to a courthouse official.
Because of the collision, Gertrude McBride claimed she sustained injuries to her head, neck, shoulder, back and body while Cecil McBride III sustained leg injuries.
The complaint alleged Mack negligently made an unsafe lane change, failed to yield the right-of-way, failed to control his speed, drove inattentively and drove while distracted.
Both McBrides claimed they incurred medical costs; experienced mental anguish, physical pain, suffering and disability; lost their enjoyment of life; lost wages; lost their earning capacities; and sustained physical impairment, the suit states.
Gertrude McBride was seeking a judgment in excess of the minimum jurisdictional limits of Jefferson County District Court, plus costs, pre- and post-judgment interest and other relief the court deems just.
