Accountant pursues legal action against former client over outstanding invoice

GALVESTON - An accountant seeks payment on an outstanding invoice and has pursued legal action against his former client.

David Gerow filed a lawsuit against Acuity Marketing Inc. in Galveston County District Court on Nov. 15, stating the company owes him $40,313 for 161.25 hours of his services.

Acuity, doing business as Car Pro, hired Gerow last February as an independent contractor to overhaul its "dysfunctional" accounting system.

Gerow's responsibilities were "preparing balance sheets and statements of operations, planning and implementing a budget process; attending strategy sessions; presenting the budget process to management of the business units; and consulting regarding various matters."

According to the suit, the plaintiff ended his professional relationship with Acuity when it supposedly refused to take his accounting advice.

He provided the defendant the invoice in question prior to his departure.

"Despite multiple demands for payment of his invoice, Acuity refuses to compensate Gerow for his services," the original petition says.

Attorney Stewart H. Thomas of Hallett & Perrin PC in Dallas is representing the complainant, and Galveston County 212th District Court Judge Susan Criss is presiding over the litigation.
