Business demands compensation for painting services

GALVESTON - Claiming it is owed for painting services from over the summer, R.S. Painting Inc. has filed a lawsuit.

Recent court documents filed Dec. 2 in Galveston County District Court assert that Bay Point Builders Inc.'s supposed delinquency violated an agreement between them.

BPB hired RSP last June to provide the aforementioned services for three residential construction projects, subsequently executing an oral contract.

The plaintiff performed the tasks in question and submitted invoices for payment.

According to the original petition, BPB refused to pay said invoices "despite numerous demands for payment."

"By accepting the plaintiff's performance and refusing to pay the plaintiff's invoices, the defendant breached the contract causing damages to the plaintiff in excess of $10,000," the suit says.

RSP adds the respondent committed fraud, stating the latter entered into the contract "without any intent to pay."

Attorney Cris A. Rasco of The Rasco Law Firm in Texas City is representing the complainant, and Galveston County 405th District Court Judge Michelle Slaughter is presiding over the litigation.
