A couple is seeking a declaratory judgement declaring their home to be their homestead property, allowing it to be free from a judicial judgement against the husband.

Thomas W. Harrison and Denise A. Harrison filed a petition for declaratory judgment Nov. 25 in Jefferson County District Court against Prosperity Bank. 

According to the petition, the Harrisons purchased a property at 2615 Regina Lane, Beaumont, on May 13, 1987, and have remained at the property and maintained it as their homestead since that date.

On Feb. 21, 2012, Prosperity Bank filed a lawsuit against Thomas W. Harrison seeking to enforce a Guaranty Agreement which it claimed was executed by Harrison. The Harrisons are claiming that any money allegedly owned to the defendant is unrelated to any debt that may lawfully encumbrance their homestead property.

The Harrisons seeking a judgment declaring the property at 2615 Regina Lane their homestead, and to declare specific liens against the property invalid, among other prayers for relief.

They are being represented in the case by attorneys Keith Kebodeaux, Casey Hargroder and H. Scott Alexander.

The case has been assigned to Judge Milton Shuffield, 136th District Court.
