A man is suing Chase Bank after they allegedly attempted to foreclose on his home.
Harvey Coffman filed a lawsuit against JP Morgan Chase Bank NA on Nov. 25 in Jefferson County District Court, citing breach of contract and violation of the Texas Deceptive Trade Practices Consumer Protection Act.
Coffman says that on April 27, 2005, he entered into a Texas Home Equity Note with the defendant JPMorgan Chase Bank and the bank is the current holder of the note and is attempting to foreclose.
Coffman claims he is not in default on the note and has attempted to cure the default with the bank, but the bank has failed to comply with the terms of its requirements. The complaint further claims that Coffman has the ability to pay his mortgage, but the defendant is attempting to wrongfully foreclose on the property.
Coffman is seeking an undisclosed amount of damages. He is being represented in the case by attorney Walter D. Snider.
The case has been assigned to Judge Donald Floyd, 172nd District Court.
