Kilgore Industrial Supply sued after vehicle strikes car on shoulder

A Port Neches resident is suing after a car collided with his vehicle while he was on the shoulder of the road.

James Thomas Mitchell filed a lawsuit Dec. 3 in the District Court of Jefferson County against Kilgore Industrial Supply LLC, Jeffery Scott Kilgore and Cory Daniel Ellis, citing negligence and respondeat superior.

According to the complaint, on May 20, Mitchell was driving northbound in the 2100 block of Interstate Highway 10 S. when he began slowing due to mechanical problems and pulled off onto the shoulder.

Mitchell says that while he was on the shoulder, Ellis struck his vehicle. During the time of the accident, Ellis was driving a vehicle owned and insured by Kilgore Industrial Supply LLC and Jeffery Scott Kilgore, according to the complaint.

Mitchell is seeking an undisclosed amount in damages.

He is being represented in the case by attorneys Lance P. Bradley and Craig J. Tahaney II of McPherson Hughes Bradley Wimberley Steele & Chatelain.

The case has been assigned to Judge Gary Sanderson, 60th District Court.
