Commissioned workers sue McKinney business for overtime wages

SHERMAN - Several East Texas workers have filed a lawsuit claiming their McKinney employer violated federal law by failing to pay overtime wages. 

Willis Smith, James Michael Stockton, Jimmy Michael Doyle, Amber Nicole Steitle, and others similarly situated, filed suit against RMCN Credit Services Inc., Douglas Parker, and Julie Parker on Dec. 11 in the Eastern District of Texas, Sherman Division.

The plaintiffs are former commissioned employees of the defendants, who worked in excess of 40 hours per week but were not paid overtime for doing so.

The defendants are accused of violating the Fair Labor Standards Act.

The lawsuit is seeking an award of actual and liquidated damages for overtime pay, attorney’s fees and court costs.

The plaintiffs are represented by David F. Wishnew, Steven W. Hopkins and Greg P. McAllister of Gruber Hurst Johansen Hail Shank LLP in Dallas. A jury trial is requested.

U.S. District Judge Richard A. Schell is assigned to the case.
