SHERMAN - A few employees of a sports bar have filed a lawsuit claiming they were not paid minimum wages.
Rachel Ayers, Bryan Burns and Kevin Loden filed suit against Vitty’s of Texas, Vitty’s Club Inc. and Robert J. Vittitoe on Nov. 15 in Denton County District Court. The defendant removed the case to the Eastern District of Texas, Sherman Division on Dec. 13.
Vitty’s Sports Bar is accused of paying the plaintiffs less than $7.25 per hour in cash wages and taking a tip credit from customer tips to satisfy the $7.25 minimum wage.
The defendants are further accused of failing to pay Ayers and Burns any wages for some weeks that they worked, failing to pay plaintiffs for overtime hours worked and for firing Burns in retaliation for making complaints of the illegal wage and hour practices.
In addition, the employees claim Vitty's withheld money to pay for their required uniform shirts.
The defendants are accused of violating the Fair Labor Standards Act.
The lawsuit is seeking an award of damages for unpaid minimum wages, deductions from tips, overtime pay, liquidated damages, interest, court costs and attorney’s fees.
The plaintiffs are represented by Robert J. Wiley and Casey M. Ransom of Rob Wiley PC in Dallas. A jury trial is requested.
