MARSHALL - A former Target employee has filed a lawsuit claiming that the store failed to pay her more than $100,000 from a court agreement resulting from an on-the-job injury.
Debbie Mathis filed suit against Target Corp. on Dec. 16 in the Eastern District of Texas, Marshall Division.
Mathis was awarded $117,240 in an arbitration agreement with Target stemming from an on-the-job injury on April 4, 2012. According to court documents, Mathis was injured when a co-worker quickly turned a powered pallet jack and the momentum shifted a stacked, 200-pound load. The freight fell off the pallet jacket, and the load struck Mathis from behind. She fell down and into the end cap shelving.
She required shoulder and knee surgeries. She was also terminated from Target in Nov. 2012 for missing work due to the accident, according to the suit.
Target is accused of breach of contract, violation of the Texas Deceptive Trade Practices Act and the Business and Commerce Code for failing to pay the arbitration agreement.
The plaintiff is seeking an award of $117,240 damages, three times the damages for mental anguish and economic damages, punitive damages, attorney’s fees, interest and court costs.
