Lombardo’s Bonded Tree Service has filed suit against Morgan Building & Spas and ATMC Investments, seeking to recover payment for debris removal.
The suit was filed Dec. 24 in Jefferson County District Court.
According to the lawsuit, in May 2012 the parties entered into an agreement wherein plaintiff agreed to haul off debris created by demolition of improvements previously constructed on the real property owned by defendants at 1795 Interstate 10 East, Beaumont.
The suit says the plaintiff fully performed all conditions under the contract and has “clean hands and is entitled to” equitable relief.
The amount still owed is $5,304.25, the suit states.
The plaintiff is suing for the amount owed, interest and attorney’s fees.
Beaumont attorney Marc Henry of Henry & Fuller represents the plaintiff.
Judge Gary Sanderson, 60th District Court, is assigned to the case.
