A Beaumont resident is suing for alleged violations of the Fair Debt Collection Practices Act.
Eloise Gums filed a lawsuit Jan. 13 in the U.S. District Court for the Eastern District of Texas, Beaumont Division, against Asset Recovery Associates, citing violations of the Fair Debt Collection Practices Act.
The complaint alleges a person other than Gums incurred a debt with Arcadia Finance, which was then transferred to Asset Recovery Associates for collection.
The plaintiff claims that on Nov. 24, Asset Recovery Associates contacted her and stated it was attempting to contact the debtor, who was the plaintiff's grandson-in-law.
The plaintiff says she informed the defendant she was not associated with the debt and the debtor could not be reached at her telephone number.
In response, Gums alleges the defendant threatened her in violation of the Fair Debt Collection Practices Act, according to the complaint.
She is seeking actual damages, statutory damages, punitive damages, injunctive relief and costs.
