A man is suing after his all terrain vehicle broke down immediately following repair.
Jim Bulgier filed a lawsuit Feb. 7 in the Galveston County District Court against Mainland Cycle Center LLC, citing the Texas Deceptive Trade Practices Act.
According to the complaint, on Dec. 15, 2012, Bulgier took his 2008 ATV to Mainland for repairs. When he picked it up, Bulgier claims there appeared to be an oil leak, but an employee assured him the oil was leftover from the repair and not a leak, the suit states.
Bulgier says when he brought the ATV home and drove it, the engine failed, and there appeared to be no oil in the ATV.
According to the lawsuit, Mainland offered to repair the ATV for free, but required Bulgier to pay for the $15,000 engine replacement part.
Bulgier is seeking actual damages plus costs.
He is being represented in the case by attorney Martyn B. Hill of Pagel, Davis & Hill PLLC.
