A Houston restaurant is being sued over claims of violating the of Americans with Disabilities Act and the Civil Rights Act.
Equal Employment Opportunity Commission filed a lawsuit Feb. 20 in the U.S. Court for the Southern District of Texas-Houston Division against PNS Investments Inc., doing business as Nick’s Restaurant and Sports Lounge, citing violations of the Americans with Disabilities Act of 1990, Title VII of the Civil Rights Act of 1964 and Title I of the Civil Rights Act of 1991.
The complaint states Laura Kercheval was an employee of the defendant and the defendant failed to reasonably accommodate Kercheval’s disability and subjected her to unwelcome comments and touching of a sexual nature.
In addition, Nick’s Restaurant and Sports Lounge retaliated against Kercheval after she requested reasonable accommodation of her disability, according to the complaint.
Equal Employment Opportunity Commission is seeking injunctions and other forms of relief.
The plaintiff is being represented in the case by EEOC attorneys Kathy D. Boutchee, P. David Lopez, James Lee and Gwendolyn Young Reams.
