City of Winfield, police sued after fatal shooting

New York residents are suing, alleging a Winfield police officer wrongfully shot and killed their family member. 


The Estate of Brian Michael Fuller, Brian S. Fuller, individually and on behalf of the Estate of Brian Michael Fuller, and Bryce Anthony Fuller filed a lawsuit Feb. 26 in the Texarkana Division of the United States Court for the Eastern District of Texas against the city of Winfield, Police Chief Tyler Bannister,  Officer Charlie Walker and Does 1-10.

The complaint states on Feb. 29, 2012, Walker arrested Fuller in Franklin County and transported him to a warehouse just outside the city limits of Winfield.

According to the complaint, Walker fired one or more shots into the vehicle where Fuller was being held when Fuller fled the vehicle while unarmed and handcuffed, Walker repeatedly shot Fuller, killing him, the suit states.

The plaintiffs are seeking an undisclosed amount of damages.

They are being represented in the case by William B. Harrell of Law Office of William B. Harrell and Ed Moriarity of Moriarity Badaruyddin & Booke LLC.
