Dog, chained up in yard attacks girl; mother sues

The family of a child who was allegedly the victim of a dog attack is suing the dog's owner.


Berta Cruz, individually and as parent and next friend of Jazmine Cruz, a minor, filed suit in the Galveston County Court at Law No. 3 on Feb. 27, naming Joe Willie Brisco as the defendant. 

According to the complaint, Cruz says she and her daughter were at Brisco's home in Dickinson, on Feb. 29, 2012, when the incident occurred. Cruz claims they were attacked by Brisco's mixed breed dog.

Cruz says they were playing in Brisco's back yard when the dog, which was chained and in Brisco's yard, somehow reached Jazmine Cruz, causing injuries to her head. Berta Cruz then allegedly grabbed Jazmine, but was attacked in the process.

Despite the fact that Brisco's dog was chained up and confined to his yard, he is being sued for negligent handling of animals.

The plaintiffs are seeking an undisclosed amount in damages.

They are being represented by attorney E.A. Trey Apffel III.
