A couple is suing over claims a Galveston County man breached a home sale agreement.
Winfield Nagle filed a lawsuit March 6 in the Galveston County District Court against Timothy Jay Cohen, citing breach of contract.
According to the complaint, on Jan. 21, Nagle and his wife made an offer on a house Cohen was selling, and entered into an agreement with the defendant to buy the house, including a $2,000 deposit.
Nagle says on Feb. 21 when the transaction was to close, Cohen was seen entering into an agreement with another buyer. The lawsuit also states Cohen never refunded the Nagles' $2,000 deposit.
Nagle is seeking an amount in damages to be determined by the court, including costs.
He is being represented in the case by attorney Christopher L. Johnson and Russell F. Plackemeier of Lyons & Plackemeier PLLC.
