Woman says State Farm underpaid collision claim

A Brazoria County woman is suing over claims her insurance company failed to pay her motor vehicle collision claim.


Joy Holt filed a lawsuit March 21 in the United States Court for the Southern District of Texas Galveston Division against State Farm Mutual Automobile Insurance Co., citing underinsured motorist liability, breach of contract and unfair settlement practices. 

According to the complaint, on Jan. 31, 2013, Holt's vehicle was rear-ended by an underinsured vehicle while she was insured by State Farm. Holt says she suffered severe damage, including a fractured spine. According to the lawsuit, after three written notices of the claim, State Farm finally responded, but has failed to pay the claim.

Holt is seeking more than $75,000 in damages and court costs.

She is being represented in the case by attorney J. Kirkland Sammons of Sammons & Berry P.C.
