Markel American Insurance sued by insured boat owners

A Jefferson County resident is suing after his watercraft was damaged in a storm.


Bodre Rising filed a lawsuit April 7 in the Jefferson County Court against Markel American Insurance Co., citing breach of contract, noncompliance with Texas Insurance Code, breach of the duty of good faith and fair dealing and fraud. 

The complaint states Rising was the owner of a Watercraft Insurance Policy issued by Markel Insurance and filed a claim after a boating incident severely damaged the watercraft.

The plaintiff alleges the defendant denied and underpaid covered damages due to an unreasonable investigation of the claim. To date, the plaintiff has not received payment in full for the damages, according to the complaint.

Rising is seeking monetary relief over $50,000, but not more than $1 million.

The plaintiff is being represented in the case by Shaun W. Hodge of the Hodge Law Firm PLLC in Galveston.
