Florida man sued over defamatory emails, phone calls

A Harris County company is suing over claims a Florida man is sending harassing emails and phone calls and attempting extortion.


Matthews Daniel Co. filed a lawsuit April 14 in the Houston Division of the United States District Court for the Southern District of Texas against Robert Pearcey, citing defamation.

According to the complaint, Pearcey, as an agent for David Fisher, and Fisher himself, have sent malicious emails to Matthews Daniel executives and some of their top clients, disparaging the company's ethics and citing an alleged automobile accident in Abu Dhabi and an employment dispute.

Matthews Daniel, a marine warranty, surveying and appraisal company for the energy industry, says these emails escalated to phone calls and threats that alluded to past violent acts by Fisher.

The lawsuit states Fisher visited a legal agent associated with the company who advised him to stop the unlawful threats and bring a personal injury suit if he saw fit. Instead, Matthews Daniel says Fisher continued the defamation and demanded $250,000 to stop the harassment.

Pearcey, on behalf of Fisher, is accused of defamation, business disparagement, tortious interference with existing and prospective business relations, civil conspiracy and violation of the Racketeer Influenced and Corrupt Organizations Act.

Matthews Daniel is seeking a temporary and permanent injunction and more than $75,000 in damages and loss of profits.

It is being represented in the case by attorney Mark C. Clemer of Brown Sims PC in Houston.
