Savant's Collision Center sued by GEICO on fraud allegations

An insurance company has filed a lawsuit against a towing business that allegedly committed numerous wrongful acts.


Government Employees Insurance Company (GEICO),as subrogee of Randy Ptacek, filed a lawsuit April 23 in the Jefferson County District Court against Savant's Collision Center Inc. and Jefferson County Sheriff's Office, citing common law fraud and conversion. 


The complaint states Savant's Collision Center towed Ptacek's vehicle on Feb. 25. Savant's Collision Center, or its tow truck driver, falsely informed Ptacek that all towing costs would be covered by his insurance, GEICO, according to the complaint.


The plaintiff alleges Savant's Collision Center failed to fully disclose its excessively high rates in an effort to induce the insured to use its services. In addition, Ptacek never received a first notice from Savant's Collision Center and it has failed to surrender the vehicle to the plaintiff, according to the complaint.


The plaintiff is seeking a temporary and permanent injunction, equitable damages, costs and fees.


Government Employees Insurance Company, as subrogee of Randy Ptacek, is being represented in the case by David S. Knight and Carla Bennett of David Knight & Associates in Houston.
