A Galveston County town is suing after paying for, but not receiving, a promotional video.
The city of Kemah filed a lawsuit April 28 in the Galveston County Court against Chris Swanson, doing business as Firefox Video and/or Firefox Productions, citing violation of the Texas Deceptive Trade Practices Act, fraud, breach of contract, unjust enrichment and negligence/gross negligence.
The complaint states the city of Kemah entered into an agreement with Swanson to create a professional quality video presentation for promotional purposes and to increase tourism.
The plaintiff paid Swanson, but Swanson has failed to produce anything for the city of Kemah, according to the complaint.
The complaint alleges Swanson fraudulently induced the city to pay him funds even though he had no intention of providing the goods and/or services he promised, breached the contract with the city and was unjustly enriched.
The city of Kemah is seeking actual damages, treble damages, exemplary damages, costs and fees.
The plaintiff is being represented in the case by William S. Helfand and Charles T. Jeremiah of Chamberlain, Hrdlicka, White, Williams & Aughtry.
