Man sues after truck taken from property

A lawsuit was filed after a Texas resident allegedly wrongfully took a vehicle.

Wayne Collier filed a lawsuit April 28 in the Jefferson County Court against Lonnie Ray Collier.

The complaint states Wayne Collier purchased a truck and then transferred the title to his mother, Ruby Collier, so she could use it as collateral for a $12,000 loan made for the plaintiff's benefit.

The plaintiff contends that the truck was removed from his residence by the defendant on April 12-13, 2014.

Lonnie Ray Collier admitted that he had the truck and demanded $5,000 from the plaintiff or the defendant threatened to sell the vehicle, according to the complaint.

The plaintiff states that the defendant is named as Ruby Collier's durable power of attorney, but has exceeded the authority granted in the power of attorney because Ruby Collier did not consent to the plaintiff's truck being taken by the defendant.

The plaintiff is seeking an injunction to prevent the truck from being sold.
