Customer slips on egg yolk at Kroger, files suit

The Texas City Kroger store has been named in a negligence suit.

Damon Porter filed suit June 4 in Galveston County District Court against The Kroger Co. 

According to the suit, Porter was shopping at the Texas City Kroger store on May 12, 2013, when he slipped and fell while approaching the check-out counter. A clerk who helped the plaintiff stated a child had thrown eggs on the floor earlier and the egg yolks had created a slippery condition, the suit states.  As a result of the fall, Porter sustained injuries to his back, head, right shoulder, right elbow and hip, according to the suit.

The defendant is accused of negligence, failing to provide safe premises for customers, failing to take reasonable precautions and failing to warn about the dangerous condition.

Porter is seeking damages within the jurisdictional limits of the court. He is represented by Friendswood attorney Jana K. Landry.
