A load operator for a New Boston energy company is suing after he was allegedly injured while unloading a truck.
William Brandon Sellers and Marnie Sellers filed suit June 4 in Eastern District Court of Texas Texarkana Division against Duane Livingston Trucking Inc.
According to the complaint, on March 26, William Sellers was working as a load operator for Renewable Energy Group and unloading a truck owned by Livingston Trucking.
During the course of unloading William connected an REG hose to the camlock fitting of the Livingston truck, which split and struck the plaintiff's leg, causing multiple fractures, the suit states.
The defendant is accused of:
Failing to exercise reasonable care to avoid a foreseeable risk of injury to others;
Failing to select a camlock fitting of the appropriate grade and/or material that would be sufficient for the operations for which it was intended;
Failing to adequately inspect the equipment used in the offload of product;
Failing to properly maintain the equipment used in the offload of product; and
Failing to adequately train its employees and failing to hire employees with the ability to properly operate the offload equipment and related parts.
The plaintiffs are seeking damages, pre- and post-judgement interest and costs.
