An online firearms retailer is suing over claims another retailer is using its trademarked logo.
AR15.Com LLC filed a lawsuit June 11 in the Houston Division of the Southern District of Texas against Dennis and Ilana Murray and Nexcess.Net LLC, citing trademark infringement.
According to the complaint, AR15 has used a bolt face logo in the sale of firearms, hunting gear and related items since at least 2006 and registered the mark in 2008.
AR15 says the Murrays have begun using the mark in products sold on their website HandmadeByDroids.com, and after several notifications of the infringement, the Murrays suggested the plaintiff seek legal counsel.
AR15 says they also contacted Nexcess, who hosts the defendants' site, and the company also failed to take action.
The defendants are accused of unfair competition, trademark infringement and dilution.
AR15.Com LLC is seeking judgement enjoining the defendants from using the trademarked material, damages, the defendants' profits and attorneys' fees.
It is being represented in the case by attorney Tim Headley in Houston.
