A Collin County man is suing over claims he was fired while on disability leave.
Kyle Bateman Jr. filed a lawsuit June 11 in the Sherman Division of the Eastern District of Texas against XO Communications Services LLC, citing discrimination.
According to the complaint, Bateman, who suffers from severe and disabling migraines, was hired by the defendant Oct. 22, 2012, as a Web Engineer III.
Bateman says on June 17, 2013, he requested medical leave for his migraine headaches, something his supervisor was aware of, but claims he was informed his job would be given to someone else.
The complaint says Bateman later went on short-term disability leave at his doctor's request, but alleges he was fired while on leave on Aug. 16, on false and pretextual reasons.
The defendant is accused of disability discrimination and retaliation.
Bateman is seeking lost wages, benefits, back pay, front pay or reinstatement, damages and attorneys' fees.
He is being represented in the case by attorney Adam S. Greenfield of Greenfield Law PLLC in Dallas.
