Padgett Waterfront Construction sued for failing to pay full amount owed for oysters

A Galveston County company is suing over claims another company has failed to pay the full price agreed upon in the sale of oysters.

Prestige Oysters Inc. filed a lawsuit June 17 in the Galveston County District Court against Curtis Padgett, Padgett Waterfront Constructions Inc. and Padgett Shoreline Construction Inc. 

According to the complaint, in May 2013 Padgett made a $60,000 payment to Prestige Oysters out of a $118,000 price for 2,000 yards of oysters.

Prestige Oysters says on July 24, 2013, Padgett removed the oysters from their location on Starr Drive without paying the remainder owed, in addition to causing damage to a bulkhead and removing oysters from a location not discussed or agreed upon.

Prestige Oysters is seeking more than $100,000 in damages and the rescission of the contract.

It is being represented in the case by attorney A. Craig Eiland of The Law Offices of A. Craig Eiland in Galveston.
