Beaumont company sued for breach of oral contract in sale of businesses

Breach of contract

A Beaumont company is suing over claims a man misrepresented his intention to sell property and businesses to it.


Arfeen Properties LP and Qamar U. Arfeen filed a lawsuit July 11 in the Jefferson County District Court against Micah P. Cooksey, MPC North Star Properties Inc. and Michael Gold, citing breach of contract. 


According to the complaint, Arfeen and Cooksey entered into an oral contract May 15 for the sale of certain property in Beaumont and the businesses Elite Sleep Solutions Inc. and Legacy Durable Medical Equipment Inc. for more than $1 million.


Arfeen says he contracted legal counsel to draft a written contract for $30,000 and was required to short sale liquidated stocks to close on the property with Cooksey, but Cooksey ceased all communications May 19.


Cooksey is accused of breach of contract, tortious interference with a contract, tortious interference with a prospective contract, fraud by misrepresentation and fraud by nondisclosure.


The plaintiffs are seeking actual damages, interest and costs.


They are being represented in the case by attorney Justo Mendez in Beaumont.
