Latitudes owner sued after man injured in drunken boating incident

A San Leon man is suing over claims he was injured while a passenger in a boat driven by a drunk bar patron.


Jeffrey S. Yates filed a lawsuit July 15 in the Galveston County District Court against Dave Foreman, Kurt's Dirt Inc., doing business as Latitudes Restaurant, and Kurt Matthew Vossler, individually, citing dram shop liability. 


According to the complaint, Foreman arrived at Latitudes bar and grill by boat on June 26, 2013, when he allegedly became intoxicated and invited the plaintiff and two females to accompany him for a boat ride.


Yates says after becoming concerned on the ride, he requested to be taken back to the bar, when Foreman failed to slow and struck the dock, sending Yates into the air. His injuries required that he be taken to a hospital via medical helicopter.


Foreman is accused of negligence and Latitudes and Vossler are accused of negligence and dram shop liability.


Yates is seeking more than $200,000 in damages.


He is being represented in the case by attorneys Albert Lee Giddens and Harvey Burns Jr. in Pasadena.
