Humana Insurance sued for denying client's claim related to bike accident

A Jefferson County man is suing over claims his insurance company has refused to pay his claim related to a bicycle accident.

Richard James filed a lawsuit July 9 in the Jefferson County District Court against Humana Insurance Co., citing breach of contract.

According to the complaint, James was involved in a bicycle accident in which he was seriously injured on July 12, 2012, while he was insured by the defendant. James says he made a claim with the defendant for the dental and periodontal treatment he received, but the claim was denied.

Humana is accused of breach of contract, breach of duty of good faith and fair dealing, and breach of duty of prompt payment of claims.

James is seeking no more than $75,000 in damages and costs of court.

He is being represented in the case by attorneys Paul F. Ferguson Jr. and Ryan M. Schaper of Provost Umphrey Law Firm LLP in Beaumont.
