Four sue driver blamed for causing crash after running red light

Four people have filed suit against the driver they claim ran a red light and struck their vehicle.


Gilberto DeHoyos, Carlos DeHoyos, Teresa DeHoyos and Albert DeHoyos filed suit July 23 in the Jefferson County District Court against Nilo Malabanan. 


According to the complaint, the plaintiffs were riding in a vehicle traveling east in the center lane of 3800 SH 225 Frontage Road when the defendant, who was driving south on 100 Beltway 8, ran a red light. Malabanan struck the plaintiffs’ vehicle, according to the complaint.


Because of the collision, the plaintiffs incurred medical costs, experienced physical pain and suffering and endured physical impairment, the suit states. They also lost earnings and their earning capacities and suffered mental anguish, the complaint says.


The plaintiffs blame Malabanan for causing the collision, saying he negligently failed to keep a proper lookout, failed to keep a proper distance from another vehicle, drove too fast, failed to apply his brakes, failed to stop at a traffic control device and failed to stop at an intersection.


The plaintiffs are seeking damages within the jurisdictional limits of the court court, plus pre-judgment interest at the maximum rate allowed by law, post-judgment interest at the legal rate, costs and other relief the court deems just.


They are being represented by attorney Jeffrey T. Roebuck of Roebuck, Thomas, Roebuck and Adams in Beaumont.
