Postmaster General sued after letter carrier reports alleged discrimination

A woman is suing over claims she was discriminated against in her position as a letter carrier and her employment was terminated after an injury on the job.


Kimberly L. Cox filed a lawsuit Aug. 4 in the Marshall Division of the Eastern District of Texas against Patrick R. Donahoe, as Postmaster General, and the United States Postal Service, citing civil rights violations.


According to the complaint, Cox was a letter carrier for the Kilgore Post Office, and in July and August 2012 she reported instances of alleged discrimination against white employees by a black supervisor to Postmaster McQuiston, who failed to take action.


Cox says she then sustained injuries after tripping on a curb on the job Aug. 21, 2012, was placed on emergency leave by McQuiston on Aug. 31, 2012, followed by termination of her employment effective Nov. 15, 2012. The defendant is accused of gender/race discrimination and retaliation (hostile environment).


Cox is seeking damages and attorney's fees. She is being represented in the case by attorney Rebecca L. Fisher in Waco.
