A doctor claims he paid more than $200,000 to refurbish a vehicle that was never delivered to him.
Dr. Stephen Wiles filed a lawsuit July 30 in the U.S. District Court for the Eastern District of Texas Tyler Division against Racefab and Martha Jackson.
In his complaint, Wiles alleges he asked Racefab to fabricate a GT-1 C6 race car in May 2011. Wiles provided the engine, air intake, carburetor and transmission gear he wanted in the vehicle, according to the complaint.
By August 2013, Racefab had not completed the vehicle, but told Wiles it was getting very close to completion, the suit states. It made the same statement in September, but the vehicle was still not finished by November, the complaint says.
The defendant proceeded to invoice Wiles for thousands of dollars of purported services without his consent and has refused to deliver the vehicle, Wiles claims. The plaintiff has paid Racefab no less than $223,775.16 and has received nothing in return, the suit states.
In May, Wiles sent a letter to Racefab demanding his vehicle be delivered, but Racefab responded by saying the automobile was still not finished, the complaint says. It demanded additional money from Wiles, he claims.
In his complaint, Wiles alleges breach of contract, fraud and negligent misrepresentation against the defendants. He says they violated the Texas Deceptive Trade Practices-Consumer Protection Act.
Wiles seeks damages of no less than $75,000 or, in the alternative, possession of the vehicle or return of the engine, air intake, carburetor and transmission gear box.
He also seeks attorney's fees, pre- and post-judment interest and other relief the court deems just.
He is being represented by attorneys Keith Miles Aurzada and Jay L. Krystinik of Bryan Cave in Dallas.
