Woman says man's negligence, drinking led to accident

A Galveston County woman says that she was injured in a crash the defendant caused while driving under the influence of intoxicants.

Brittany Wells filed suit against Shawn Jason Wark in Galveston County District Court on Aug. 5. 

According to court papers, Wells was driving southbound on FM 646 when defendant Wark, traveling northbound, swerved into the southbound lane of traffic and struck the plaintiff's vehicle.

Police investigated and determined that Wark was intoxicated above the legal limit. The lawsuit says that as a result of his negligence in failing to yield to oncoming traffic while making a left turn, in failing to make timely and proper application of the brakes, failing to keep a proper lookout, failing to control his vehicle and stay within his lane of traffic and in operating the vehicle while intoxicated, Wells was seriously injured.

The plaintiff is seeking a judgment in an amount above the jurisdictional minimum as compensation for medical, hospital and pharmaceutical charges and expenses in the past and that will be incurred in the future; for loss of earning capacity in the past and future; pain and suffering, mental anguish, physical impairment and disfigurement as well as exemplary damages. The plaintiff also seeks pre- and post- judgment interest and court costs.
