A Polk County man has filed a negligence claim after an alleged motorcycle crash in San Jacinto County.
Neil Allen Darby filed a lawsuit against Transco Express Corp., Johnny Ray Thrasher Jr. and Danny Madden on Aug. 19 in the Houston Division of the Southern District of Texas.
According to the complaint, Darby was driving his motorcycle on U.S. Highway 59 in San Jacinto County just after noon Oct. 5, 2012. He says he was driving in a "normal and prudent manner when suddenly and unexpectedly" the vehicle being driven by Thrasher entered his lane of travel, causing him to lose control of the motorcycle and crash.
Darby contends Thrasher, Madden and Transco Express, the company they were working for at the time of the crash, are negligent for failing to keep a proper lookout and failing to have a proper escort.
Darby says he received serious injuries in the crash and is asking for an unspecified amount of money in damages for medical expenses, physical pain, mental anguish, disfigurement and impairment.
