A man claims his insurance company has failed to timely pay him benefits owed to him after an unknown driver rear-ended his vehicle.

Austin Hirsch filed a lawsuit Sept. 4 in Galveston County District Court against State Farm Mutual Automobile Insurance Co. 

In his complaint, Hirsch claims he was driving on Interstate 45 at NASA Road 1 in Galveston County on April 26, 2013, when an unknown driver rear-ended his vehicle, pushing him into a concrete wall.

Because of the collision, Hirsch suffered physical pain, mental anguish, physical impairment and disfigurement and incurred medical costs, the suit states. He also lost his earning capacity, the complaint says.

At the time of the collision, Hirsch had an insurance policy through State Farm that was supposed to cover him if he sustained damages in an accident with an underinsured/uninsured driver, according to the complaint filed Sept. 4 in Galveston County District Court.

Although Hirsch has notified State Farm of his damages, the insurance company has failed to reimburse him, the suit states.

In his complaint, Hirsch is seeking an unspecified judgment, plus pre-judgment interest at the legal rate, costs and other relief the court deems just.
