A Jefferson County man is suing over claims his commercial tenant failed to pay rent for nine months.
Thu Van Nguyen filed a lawsuit Sept. 25 in Jefferson County District Court against Alimo Investments Inc., citing breach of contract.
According to the complaint, on Oct. 11, 2011, Alimo Investments entered into a real property lease with Nguyen to rent two properties on College Street for $4,000 a month for the first 10 years of the lease.
The complaint states the lease commencement date was Aug. 1, 2011, and the termination date was July 31, 2041, but Alimo Investments has not made a lease payment in nine months.
Nguyen says he has learned that Alimo made unauthorized modifications to the property and he fears it will try to remove the modifications and cause more damage to the property. Alimo is accused of breach of contract.
Nguyen seeks damages, attorney fees, interest and a temporary restraining order, temporary injunction and permanent injunction preventing the defendants from conducting business on the property, keeping the plaintiff from the property, or making any further modifications to the property.
