Holding company says borrower owes nearly $20K

A debt collection company filed suit against a borrower for alleged breach of contract.

Nancy Holding Corp. of Great Neck, N.Y., filed a complaint Sept. 24 in Galveston County District Court against South Shore Enterprises Inc. and Elaine Marak, citing breach of contract.

According to the complaint, the defendants entered into a credit agreement with the plaintiff's predecessor. The defendants allegedly defaulted on the obligation to make payments due under the original contract. The plaintiff states that the defendants were given all notices of the debt, as required by law, but the defendants never paid the balance due. The entire balance of the contract is currently due, the suit states.

Nancy Holding Corp. seeks payment of the $19,153.48 due on the contract plus interest at the maximum rate allowed by law, attorney fees, court costs and any other relief as determined by the court.
